without a 30 days notice A tenant moved 2 days ago, He dindt tell me I knew because my maintenance man was there and saw him moving everything, when I went there I knocked the door several times to see I opened the door on Friday and I noticed only a few things there. I called the tenant and he doesn't respond phone anymore. I came back yesterday and found someones else he told me he is his roommate (but he is not in the lease) I told him if he is not on the lease he can't be there he said he will be out tomorrow. I
But I wonder if he doesn't what do I need to do?

Treat the situation as an unauthorized squatter. Call the local police department and report an unwanted subject that needs to be removed.....

After 30 days, your unauthorized roommate/squatter is a tenant who needs to be evicted.

Offer to pay him this new T some money to get out immediately. Go with new locks and cash. Have someone to help get his stuff out of the house. Then change locks. Put up No Trespassing signs and ask the police to patrol the area to watch for anyone other than your maintenance man.
It might be cheaper than doing an Eviction.

He is not a squatter, he's a trespasser. Your tenant moved out. If he left behind any items of value, you may want to hold on to them in storage for 30 days to be sure tenant does not return to claim them. Use his security deposit to store, and later dispose of those items left behind. If the trespasser returns at any point(You should now change all the locks!)call the police if he refuses to leave. You're under no obligation to now rent to this "roommate" that never existed before, never applied for tenancy, never paid a deposit, and who sliped in unauthorized.
