Can a landlord refuse to accept cash and require tenants to pay by check/cashiers check/money order?
My 83 year old father has owned a 4 unit building for about 45 years. He is having a harder time getting to the building (about 15 miles from his home) to collect monthly rents. He would accept cash or check (mostly cash) and provide a receipt. He is requesting that the tenants now pay by check; sent by mail. One tenant is insisting on paying by cash and getting a receipt. He showed up at my father's front door providing cash and asking for a receipt. Pretty sure it's less about getting a receipt and more about not having a bank account for some reason, but that is probably pretty obvious to most. Also, I am pretty sure there is no written lease agreement with the problem tenant. They were there when my father bought the property! Thanks in advance for your help...

Part Of me says that your father should ACCOMMODATE his long, long, LONG term customer(tenant), by accepting the cash. It's a possibility that the tenant does not know or trust himself, on how to use a check book. The other part of me says the long term tenant should accommodate his long term, 83 year old landlord, by at least getting a cashiers check or money order from wherever he gets his cash from, and send it thru the mails. Is there a possibility that YOU could go to that tenant, and collect the rent, in whatever form, and get it to your dad? It sounds as though this may be a good time for YOU to step up, and inform all the tenants that you will be collecting rent from now on, on behalf of your dad, and let your dad enjoy his retirement years he has left.

He's been a paying tenant for 45+years? Accommodate him, because tenants who pay, and want to continue to pay, seem to be a rare find. I agree with G and Stephen.

It's not reasonable to require payment by money order. You don't need a checking account to get a money order. I would be very concerned about my elderly father walking around with large amounts of cash on hand, regardless of neighborhood.

Having people show up at his door with cash is not safe to me. Unless you plan on collecting rent yourself, I would continue to ask people to pay mail from here on out. The safety and security of my father would be my number 1 concern.

Too many people plotting these days for situation just like this. Money order payment via mail is the safest bet in my opinion.

Hopefully your tenants have advocates on their behalf as you are your father. It only takes the wrong person to find out about large amounts of cash being carried on schedule bases to tempt the wrong person. Good luck.
