I rented to a guy with a 6 month lease to convert to month to month after that period.

He called me at the beginning of the month to tell me he was moving out at the end of the month. i told him he has to give me 30 days notice in writing.

I got a letter yesterday telling me again, that he is moving out at the end of this month, like he told me, on the phone, on the2nd. He gave me several reasons why he does not want to rent from me any longer.

So, what would you do?

He was hardly at the apartment this whole time of the lease for various reasons and stayed with his wife at her place most of the time and now he wants to go back to her.

I am in a bit of a quandary but I am also feeling used.

He paid his rent; hopefully you can flip it quickly.
I know what the lease says but some people can't follow thru with written responses.
If he was estranged from his wife, he probably is short on money and can't afford his place and whatever he spends on his place.

I never write leases. It doesn't protect me one bit. People do what they are goingvto do.

Are you the anonymous that I just answered a few minutes ago? At any rate, if a T want to move out, there is nothing you can do to stop them. For now, request the keys back on April 1, which gives you possession back. Tell your T you will mail him a letter within 30 days, after the keys are returned, as to what you have done with his deposit. Some states define that you have "notice" of something, when you FIRST find out about that "something", regardless of what "form" the "notice" comes in. So if you try to make the T pay for April, because you required a 30 day minimum WRITTEN notice, it's possible a judge could rule against you. I'm just sayin. Right now, just focus on your goal of getting keys/possession back, the easiest way possible, and worry about everything else after that.

Heck, let him go. I'm a tenant, and as a tenant I would not want to rent from a landlord who does not want to rent to me, and this should be the same way you look at it, you don't want to try and force someone to stay when they're so adamant about leaving. There are plenty others out there who need a home.
