Lease is until August 2017. Tenant was evicted 2 days ago. Do I am trying to re rent. Do I return balance of deposit or hold accountable until re rented per lease?

When a LL evicts a T thru a court system, YOU choose to get rid of the person, rather than collect rent. You must stop charging any rent against that person on the day you evicted them. You can charge any unpaid rent up to the day the person was actually put out of your place, but none after that date. Basically, you chose the eviction process to end your lease prior to the August 2017 date. In general,you will have 30 days from the eviction day, to send them a certified letter as to what you charged them against their deposit. Rent, damages they created and you repaired, and costs to evict them, are all chargeable against their deposit. If they end up owing more than their deposit covers, you, again, have the choice to go after them in court to try to get the rest.

Thank you. I do not go after tenant for owed money as it is not woth unless do without an attorney.
