Tenant had been in the house for 20 months.
He knows it is his responsibility to take care of the landscaping,it is in the lease agreement. We had been with this problem before. I sent a landscaper , clean the front yard and charge it to him the next month, no problem he paid. An this is a provision in Nevada, I am able to do that.
But now he said he can not afford it. It is so bad that I had the inspection of the city , He knows that because he gets the letter too. They give you time to fix it. Actually the Inspector it is very nice and she understand my position, she extended me the date. This time when I sent him the letter That I would send a landscaper to fix it and charge it in the next month he said he already hire somebody and it was going to be done next day, I answer that I would do an inspection 6 days later. But 6 days later nothing had been done, in the meantime I get the letter from the city. So I tell him again I will send somebody to do the job and he said he can not afford it that he would do it himself. I said that the inspection is today so I gave him time til yesterday. He did probably half. So I thank him for that but still it has to be done today because of the inspection and probably it will be half price too. he said that he will not pay. So what shall I do?

You first take care of your property.

You send the bill for the landscaper bill with a letter stating you expect payment in full with the May rent.

When he fails to pay it..on May 2 you post a "quit or pay" notice according to your state law. Include an itemization showing the money paid first applied to the landscape bill..the remainder to the May rent...with the amount of May rent left unpaid. Require payment within the notification days (in NY it is 3 days)

Then you file for eviction.

If he pays...as soon as his lease is up..give him the notice to move. You do not need to give a reason ... but maybe you could suggest to him that his next place be just a simple rock garden.

Oh...and in the future just make the rent sufficient to cover the landscaper. For me it is a great excuse to have one of my guys around the property...something always need trimming, pruning, etc. great way to know what is going on...and the neighbors will always tell you too.

Plus... you get to skip the drama from the tenant that doesn't want to pay for the service or is too lazy to actually do the work.

Raise the rent, get another tenant. Tenants will not do the landscaping in my experience or they will do it half-assed

Tenant is stringing you along and playing you. KatieKateNY had a good answer.
