The lease expires on 06/30. It is at that point that the responsibility of both tenants ends. If you use a renewal adendum, it is essentially an extension of the existing lease that with new end dates. You do not have to use a renewal if you do not wish to.

Alternately, you can write up a new lease without the girlfriend's name on it IF you wish to keep the boyfriend as a tenant. I do suggest you recheck the boyfriend's income to confirm that he can indeed qualify for the unit on his own.

I understand G's concern about tenant drama causing landlord problems, but as long as nothing illegal has occurred between the tenants and it has not disrupted other tenants, then I would not have a problem with keeping the boyfriend as a tenant. I assume this is why you sent out the letter offering the renewal in the first place.

Offering a renewal does not equal a new contract. It is an offer, an intent to rent. Until a new lease is signed (or a renewal addendum), you have not secured a tenant and the tenant has not been guaranteed the unit. However, it is in your best interest to get the paperwork signed if the boyfriend is to stay or to get a letter from hm that he will not so you have suffucient time to advertise and rerent if needed.

Press the girlfriend to give you something in writing that she will be moving out. If that is what happens, don't forget to properly handle the security deposit. If NJ is like other states, the security is not released until all tenants have vacated...which means she would not receive her portion on her move-out. We usually settle these sort of situations by inspecting the unit for damage, having the remaining tenant sign a document that they accept full responsibility for any damages in the unit, have the tenants settle damae costs between them, and then have the vacating tenant sign a document 'transferring' their portion of the security to the remaining tenants.
