Thanks. But is that clause is unenforceable even I have signed this on the contract? I just don't know the "norm" of the contract coz it was my very first time to rent an apartment in the city.

No lease can supercede state law.

You could sign a document giving away your rights and it means nothing. You cannot sign away the protections of the State.

A per day late fee is abusive.

I am certain the judge will thro wit out. My own lease changed after a judge in NY set me straight.

Katiekate, lamac66, and I, have all said the same thing to you, but in our own ways. What you need to spend the summer doing, is reading up on New York's LL/T laws, so you know the laws, to be able to go to court and WIN.
