Thank you for your reply! Yes, I did do the references myself. Got the contact numbers from google searches (they matched the application) and called in to the switchboards and asked for the reference individual. I also had them send me to the HR/payroll department and verified the employment through them. I verified the owner of their current rental through county records and found where he worked (LinkedIn) and called that number and again verified through the switchboard that he was human. I left a message though b/c he was in a meeting.

Chapter 7 IS available to sole proprietors and partnerships. They were sole proprietors. I do have official copies of the discharge papers, though I need to contact the lawyer and/or county to get a list of debts NOT discharged. I have never used PACE before but will look into it.

I have so far found no misinformation and have been able to verify everything they said about their business through google searches. Could you elaborate what you think might be a red flag for misinformation? What am I missing?

The first concern I have is that they said the bankruptcy might not show on their credit report......oh..so not true. It appears immediately.
Every debt will show INB. (Included in bankruptcy).

The only non discharge left debts in chapter 7 are...spouse and child support, liability from personal injury lawsuits, student loans, and some (not all) debt to IRS. Even if the debotor chooses to reaffirm a debt..it is still discharged and will show as such on the credit report. County court has nothing to do with bankrupted....it is federal court.

This is not a pick and choose, Every dischargabke debt is discharged. Period. It is all or nothing.

I wonder if they were not discharged, but rather dismissed.

I have known a few people (friends, etc) who have filed chapter 7. There is not any detail they are not totally aware of. It consumes their life for months while going through it....you KNOW if you are discharged and case closed.

Check PACER. It is the public access to the federal court. This is public information, somyou do not need permission...but get the case, date filed, and federal district court it was filed in.

    Great info.... thanks! You are right. The copy of the 'Final Decree' that I have is from the US Bankruptcy Court.
    It says "Order of Discharge" was granted. Trying to figure out how to use PACER now...
