6 mths ago we had rats in our rental property. We had problems getting our property mgmt co to communicate with us and it took three months to take care of everything. We recently evicted the tenants that were occupying the house (no lease) and they left $2000 damages. The deposit covers 1/3. They are refusing to pay due to length of time it took to get rid of the rodents and claim "we put their lives in jeopardy". Not sure what to do next. They claim there were still rats when they moved out. We haven't seen any. Any advice? Thanks.

Start repairing the damages, set traps for the rats, and get your place rented out again. Whatever the former tenants owe you, you need to decide if you want to sue them in small claims court for that amount. They don't have much of a defense about the rat problem, since they were still able to live there. If their "lives were in jeopardy" they should have moved out as soon as they knew about the rats. But they didn't. They continued to stay there, living normal day to day lives. A judge will see right thru their defense. Take them to court.

The property MGMT Co finally got an exterminator out two months after we were told. I do not know why it took so long. $400 worth of poison and traps. The garage door, (which is where we were told they were coming in) was repaired a month later.

This is on you, not the tenant. The management company is supposed to work for you, but as you've now learned, their only interest is to line their own pockets.

They did not do right by your tenants or by you, and your agent (the management company) took way too long to remedy this situation and also didn't notify you of what's going on.

Fire them, manage your property yourself, and make this right with your tenants.

Find a new property management company. Forget about chasing the T that were evicted. Just more money spent chasing to get a judgment with NO guarantee that you will ever see the money.
