i agree and yes i have all of that. what im wondering is can he try to now get late fees after we've settled everything else. i dont believe he no longer has that right.

Sometimes you have to weigh the cost of if the time money and effort is worth the trouble.
I would determine how much money would you have had to pay for late fee VS what you paid in extra rent. If the rent money number is a great deal of difference. I might pursue going to court, or at least explaining the issue to the landlord to see if you get a refund based on this extra rent payment. Other than that, learn a lesson from it and move on.
If I don’t pay my cell phone payment on time they shut me off. Or charge me a late fee. The phone company doesn’t care why the payments late. You should treat the Landlord with the same type of importance as a cell phone right.

    Thanks, im simply saying he never charged us a late fee. which is great. had he charged us one we wouldve paid it. Now that everything is settled, there was definitely an overpayment on our part. I sghould be entitled to that shouldn't I?

      NO. Technically you owe late rent fee's. It's a wash.
      Must have been a hell of a party to pay rent twice and not realize months later, until after you move out.
      Spend the money, go to court, it a toss of the dice.

If you decide to sue your LL, you will be the Plaintiff, and he will be the Defendant. Which means YOU will have the burden of PROVING your case, and he will try to defend himself in ANY WAY POSSIBLE. So, YES, he will bring up the late fees to try to offset your claim of a second rent payment in 1 month. Again, it's not what you "feel" or "believe" , it's what you can PROVE (and what HE can prove). If you "feel or believe" you have a very strong case, GO FOR IT! If you win, GREAT! If you lose, treat it as a learning experience, just as it costs to go to college, with no guarantee of getting a job in your field once you graduate.
