Judgement on tenant - Landlord Forum thread 352880

Judgement on tenant by sucker (NYS) on June 22, 2017 @11:01

NYS
I have a judgement against tenant. They have been evicted.
A lot of vandalism in home light switches removed, ran water destroyed floor, took doors off hinges, stole screens, cat urine, not to mention back rent.
Recourse?
I know they have cars/trucks motorcycles, they are employed.
thanks

Why not post the full debt on their credit report?

You may need to check with an attorney on this, but I think you can do what is called a "debtors exam" That's where you soepena(sp) the former T into court, and be able to ask the T (under oath) about all their assets they have-----vehicles, checking and savings accounts, stocks they may own, 401-ks, certs of deposit, furniture, where they are employed and how much they make, etc. After you have all that info, you can proceed to garnish wages, checking and savings accounts, put liens on vehicles, etc. Once you know the exact laws, you may even be able to force them to liquidate certain things to be able to pay you off. Again, this needs to be run by an attorney for exact details.

You can garnish their wages. Now that you have a judgement you can start taking away a portion of their earnings. You need to get some help and find out how to to this. You will need to know where they live and where they are employed. Usually you file with their local court for them to do the garnishment. The court will send information to the employers and money will be taken out of their pay and sent back to the local court (they will send you a check). It is also highly possible that they will eventually quit those jobs and try to dodge you.....you can do it again with the new employers (if you can find them). Good luck.
