I have a tenant who is perpetually late with her rent. At this point she has a balance due for April, she hasn't paid May or June. This is someone who I've allowed to pay twice a month she is always late she never hardly pays late fees even though I request her to do so. She always has some type of hardship which I like a sucker always fall for and you know make allowances for she's been in the property since 2013. I gave her notice all the way back in August and she came up with a story she can't find anything and blah blah blah anyway I allowed her to stay through the winter him and you know while she looks for something and hasn't found anything up to now. She called the last week of April I'm trying to give me two days notice to move out and wanted me to return her security deposit so should be able to pay for her new rental which I of course refuse to do because I'm no fool. She has not paid rent rent since then and after her convincing me that she's going to pay, I finally went and filed for eviction. We made an agreement that if she would come out by the 23rd and paid something toward what what she owed, I would drop the case l. The day before the agreed upon date, she called with another story. Now she wants to pay something towards the rent I told her to deposit in the bank as she usually does and she's insisting that she wants to come to my house and give it to me, which I refused. She wants to make an agreement to pay, I guess for the last couple months in and then I would give her more time because she can't find anything else. I don't want to do that at all because I feel that if she stays any longer I'll never be able to get her out. I just want to know what is my best option at this point

In my state if I accept even one dollar for rent it stops the eviction process.
If you want her out then start the eviction and follow thru with it. Stop listening to all the excuses. If you don't have the guts to follow thru hire a lawyer to do the job.

I have to disagree with you on one thing-----you ARE a fool! You are running a BUSINESS here, not a charity. As Khan said, get some backbone, and EVICT HER! Call av layer, and let him/her take over your problem of getting rid of your tenant, no matter HOW MUCH time or money it takes. It's fine to "work" with your T. But only for the first 30 days. Then, you have got to say, "enough is enough". In my state(Iowa) as in Khan's, If I accept even $1 towards rent after I start eviction procedures, I have to start the process all over again. Starting today, DO NOT ACCEPT ANY RENT UNLESS ITS FOR ALL THE RENT SHE OWES YOU-----IN CASH ONLY ! You need to follow your states LL/T laws, and the eviction laws EXACTLY ! If you don't,she could still be living there by Christmas, and never pay you one dime in rent. I know my post seems heartless to you, but sometimes there is just no saving people. I've been a LL for 37 years, and currently own 20 rental homes. I've heard a LOT of sob stories over the years. I "work" with people, too. But once they pass 30 days of not paying rent, it's time for me to say "by-by" and find another T.

BTW, in NJ, non payment of rent you don't need a notice. You can go ahead and file for eviction.
