OK. So I gave my 30 day notice. I do not have a problem paying for this and next months rent here, but I was told that I can not officially stop living in the house before the 30 days. So during the 30 days of my notice I am still require to live in the house. But I want to leave sooner then that. I dont understand how this is fair..I gave my 30 days, so why can I not leave before my 30 days is up, even thou I am willing to pay rent?

You may leave at any time you wish. What you are dealing with is an uneducated landlord. You should at the minimum keep the utilities on to prevent any damages from occurring.

As long as the rent is paid, the rental is still yours whether you live there or not. If the landlord enters and takes possession, that's an illegal eviction and you are entitled to damages and return of any prepaid rent. Otherwise, you have some weird landlord who does not know their responsibilities being a landlord. What state are you in, as some states require less notice if you are a month to month?

common sense says someone can't force you to "live" in the house. I am guessing here but probably the landlord wants the utilities kept on and the house to be "occupied" for insurance purposes. Some companies cancel policies on vacant properties.

I agree with anon. Contractually, you must keep the rent paid on time til the end of the lease. Also, if the utils are in your name now, you must still keep them on and in your name til the end of the lease. And if you are to mow the lawn, you must keep doing that, too. You can keep the keys till the end of the lease, also. But, physically, you can move out any time. By moving out early, that will give you PLENTY of time to clean the place up, and repair any damages you caused, to be able to get your full deposit back. As soon as you have done that, take pics of every room, and every cupboard, closet, the insides of the stove and refrig, etc. Once you have moved out, you should go back 1-2 times a week to be sure everything is OK at the property. Then meet your LL at the place on the last day of your lease (if possible) to do a final walk through, and give the keys back.

move all your property and trash out. clean and fix the apartment / house to back to original possession condition.

if you are in a state that requires / allows pre-move out inspections by landlord, request one in writing get all keys as issued to you by landlord and take them and a note saying simply: possession surrendered back to landlord on........... at ...........am/pm. if LL refuses, send a letter by certified mail with the keys.

if you gave PROPER 30 DAYS NOTICE (and that's what your state requires) and YOUR RENT IS PAID thru end of possession,. your LL CANNOT PREVENT YOU FROM MOVING OUT AND SURRENDERING POSSESSION EARLY.

Frankly, I cAN'T IMAGINE WHY your LL wouldn't want that extra pre-paid time.
