I have a condo that I purchase just over a year ago and for the past two years there has been a significant special assessment for deferred maintenance items. I want to offer my tenants an option to buy but am unsure of how to include any potential future assessments into the agreement. Anyone have any suggestions?

You really can't include the special assessments for a tenant. You can do it but it wouldn't hold up. The purchase option still leaves the optionee as a tenant. Perhaps you could include that dollar amount as part of the non-refundable amount that you are requiring.
