If the lease has expired, than you have a month to month rental agreement. If the tenant does die, the rental agreement is still in effect until either you or the tenants Executor Estate tends notice to terminate the rental agreement. If there is no executor, than the state will step in and handle the deceased estate. The estate will be responsible for rent and/or damages. You will need to handle the security deposit as per your state laws.

You should have emergency contact names and numbers for all your tenants on file. Check the tenants application for any references listed that you may contact if needed.

Do not just trash the place because you believe no one will care. Too many landlords wind up in court over such actions. Also, upon the tenants demise, no one should be allowed in till you hear from the executor of the estate or state officials. Not even relatives or friends unless they have legal authority.
