None of what you consider important matters. You have an agreement to sell the property. The purchaser has passed away. The property goes to the next of kin. You will have to start forclosure proceedings if there is a default in payment from the deceased estate or if the son takes on the legal resposibility of the debt. You just don't get the house back unless there is a default in receiving payments and you proceed to forclose.

well its been 6 months since mike deceased we have not received any payments we hired a lawyer all he says is its in probate can I take it to forecloser while its in probate
