I have a month to month tenant who wants to move out October 01,20017.
She paid upto sept 30.
Should I charge just for October 01 or charge for the entire month rent.
what do you think?
Please advise.

Has she been a good tenant? Paid on time, follow the rules of your building, etc?

If it were me, that's what I'd be thinking about. The other side of this is, if she's not been a good tenant, she may make you go after her for the full month. Is it worth your time and energy to even go down that road.

I would be gracious and not charge the tenant at all for one day. The only exception would be if I had an incoming tenant moving in soon and needed the time to make ready.

The extra day could be conditioned on the tenant leaving the place really cleaned for you, if not then charge for extra day.

Are you willing to go in front of a judge and let the judge decide? That's what could happen if you try to charge your T as a holdover T for 1 day, but charge them for a full month. Besides, Sept 30 / Oct 1 is still 2 weeks in the future. Visit your property on Oct 1 to see how they are doing.

Have you given your T, or any of your other Ts, a grace period of 1-5 days before you charged them a late fee on their monthly rent? If you have, a judge may say you should give your T the same kind/type of grace period to get out, as you did on your rent.

If you charge for either a day or the whole month, you have entered into a month to month rental agreement. Surely you do not want that! You would have to go to court to evict and get a judgement for holding over. A lot of time and money over just allowing the tenant the one day.
