Pro-rated rent and Keys received by Anonymous on September 21, 2017 @12:47

We are being charged for the days we've had our keys even though we didn't move into our house until 5 days later. Can we be charged just because we picked up the keys? We weren't able to move in until the weekend but picked the keys up on a late Tuesday afternoon.

Once you have the keys in hand you can and should be charged.

I tend to agree with anonymous about you having the keys so the unit is yours, but just in case there is something we missed - Were you unable to move into the house because of something the landlord was doing/had done or was the house available and you chose to wait until the weekend? That is, ignoring when you could get time off work, when you could lay your hands on the truck or trailer to move stuff, and when your friends would be available to help carry things; the house was available and accessible starting on Tuesday.

What does your lease say is your starting date? If it was the day you got the keys, than your lease started then and you would be charged for the five days.

look to what the lease says, usually on the first page. absent something in the lease, when the LL handed you the keys he gave you possession of the property.
