Can a landlord raise the tent before the lease expires to market price or is it after it expires

You need to know NY LL/T laws to know if you are required to give a 30 or 60 day notice of a rent increase. But, yes, you can give your notice during the current lease, to go into effect the day after the current lease expires, as long as you have met the minimum length of time for your notice. The 30 or 60 days are always minimums, and in some states, if you give notice in the middle of the month, the increase may not go into effect till the following date the rent is due.

So lets say their lease expires on this Oct 31. and you must give a minimum 30 day notice. You could sent that notice out next week, and start the new rent on Dec. 1 (assuming all your rents are due the 1st of each month) Their Nov. rent will be at the current amount. Just be prepared to have a vacancy if you increase the rent too much.
