You have a valid legal month to month rental agreement in effect. You first, have to give notice to terminate the month to month and than you can sign a new one year lease.

If you fail to terminate the month to month correctly, you may find you have and invalid lease that is unenforceable if issues arise.

Terminate the month to month and update your lease as many landlord tenant laws went into effect in 2014 that you must incorporate into your lease.
