I am trying to decide whether to make a new lease with my tenant or sell the property. I want to see a few more higher closings before I sell. I allowed the property to go into month to month after lease expired at end of July.

There is language in CCR'S stating the need for a lease for one year, but my tenant has been there for 4 years now. This is the 1st time I have not provided another year's lease.

The CCR'S do not have language discussing a fining process or amounts. Our HOA demands a lease be in place now and says they can fine me anyhow as the State of Florida allows for that even if an HOA's CCR'S does not discuss fines in them.

Is this true? Can they impose fines on me if I do not provide a lease?

Just prepare to sell the property for enough to cover the fine if one come up. I would list now as this economy is in a bubble currently.

Yes, they can do it.

You are also in violation of State Law. FLorida requires the payment of a hotel tax for every night unless there is a minimum 6 month lease inplace.

Fix this quick. HOA can make those fines financially painful.

I have 4 condos in 2 different Associations. Sat on the board of governors at one of them in years past. They do have this power. Just comply

What does the language in the CC&R's say about the need for one year leases, exactly? The way I see it, you DO have a one year lease still. It's still a valid contract even when it rolls into the M2M phase beyond the initial year.

It seems really unreasonable to me that the HOA could force you to do new contracts annually. I'm curious what the language actually says about it. Does the HOA have some beef with you? Are they generally nitpicky, or fine-happy?
