Why do I need the consent of the tenant ? For what? It certainly is not that I want more money, it's that I'm afraid if they won't or don't follow through with bringing the bins to the curb and back in a timely manner there will be garbage around and fines by the city to deal with. I feel bad enough about them and me having to deal with this so please know this is a genuine request asking how to deal with it. I have had a dumpster many (almost 20) years so this is a big change for my tenants and the tenants of the other two 4 units next door. With 3 four units we have 1 lge bin for garbage and another for recycling for each tenant. That's 2 bins per unit and with 12 units that could be as many as 24 bins on the curb at one time.

What legal right do you believe you have to fine the tenants for failure to remove the trash bins timely? None! In order to penalize any tenant, all parties must agree to any penalties. That means if a lease is in effect, the tenants must agree and accept such terms. If your tenants are month to month, then a change of terms can be made following your state requirement for notices.
Instead of trying to penalize for something that may or may not occur, perhaps you could offer an incentive for those that follow through by removing the bins timely.
Have you thought about contacting the city with your concern about the total number of bins that's require for your properties? They may not realize there's a problem. They also may allow a dumpster instead of the numerous bins? Your properties are commercial, so you should be able to contract for having a dumpster instead of bins.
