Denial of tenants fience - Landlord Forum thread 354675

Denial of tenants fience by Davina on October 17, 2017 @00:52

I own a trailer park in California. A current tenant who owns her own trailer divorced her husband. Now she want to move in her fience who if a convicted felon for dugs. Recently, (with in the past 6 months) he broke out their window using her head, as is now in rehab again. Can I deny him as a tenant and then evict her if she continues to have him at the park?

Yes to both

I am sure the rental agreement (end of the lot) allows you to evict for any criminal behavior. Also, those leases always contain language about endangering any other tenants in the park

You can sure ban him. Get an order of protection.

As for her....just inform her that her fiancé is banned from the park. You will proceed against her if she allows him back onto the premises

California has different regulations for tenants in mobile parks that affect how to evict a tenant. See;

Mobilehome Rent Laws

Special attention to;
798.56. A tenancy shall be terminated by the management only for one or more
of the following reasons:

If the tenants soon to be significant other is currently in drug rehab, as long as he is not doing drugs currently, he falls under the Fair Housing Act. This could complicate any actions you take against him or the tenant to avoid any discrimination complaints.

This would best to seek the advice of an attorney as residential and mobile home parks have different rules and regulations as to evictions.

Yes you can deny.

This is a tenancy you want to end asap. Good luck.
