Yes I did provide the tenant an alternative method of payment, a week before the due date. the alternative are:
I collected from his house
he can bring it to my office
or we can meet at the bank
he never answer. I even said to do it in a convenience time for him.
he did not pay November jet nor he does contact me. So now he has late fees for November.
I sent and email with the notice he is late , the one you have here in this site and he did not answer . So if by monday I do not have any answer I should to send the 5 days pay or quit. Just I want to make sure is legal to ask for october, I know erentpayment returned the funds to him I have the prove in their website, so I never received the october rent.
He had been in the house for over 2 years, he always paid rent in time until august, september and october he was late and now november. He contacted me before to tell me he was late to negotiate late fees . As he never was late for over 2 years I reduced his late fees but I said I could not reduce it again if he was late for november.

Serve notice and follow up to evict. When T start paying late. They rarely get back even. To be safe. When you file for eviction just ask for November rent. After you file do not accept any rent payments. The T should be paying that to the court after you file the eviction. If you accept any amount of rent after you file it will slow down and possibly stop your eviction process.
If you have to evict you more than likely would not ever get the October rent anyway. You could possibly win a judgment for October rent. But collecting is the hard part.

    I have last month rent, he paid that when he signed the contract the first time. So in the last of the cases it will not be so bad, but just he will get 15 days of november for free bcasue it will take that to evict and unfortunately the deposit will not cover the damage in the house. I know already what it is in the house I had n inspection.

      I think you should let tenant know that the last month rent cannot be reused as rent. If he uses he last month rent , he should move out.
      Last month rent is the last payment to be used when tenant move out.

      you have to be clear with your tenant.
      So that way, they know where he or she stands.
      Communicate your expectaction to tenant so he know what he can or cannot do.
      check to see what is going on.
      communication is the key to understanding.
