I have a large sum of money being held in rent checks that can't be cashed yet. The tenant is threatening to stop payment and not pay rent if I proceed to evict. The use and occupancy wasn't set at the first hearing as it should have been. Now the tenant is making all types of fake claims to avoid paying use and occupancy. Is there a remedy with the court to get my money. It's going to trial soon and it could be asked for then but I'm a nervous wreck until then. Any help or hope would be MUCH appreciated.

Why can't the checks be cashed? Were they post-dated, or made out in someone elses name.? If they were, WHY are you accepting them? You need to tell us the WHOLE story, before anyone can give you answers. With problem tenants, NEVER accept anything but cash or money orders.

Going to trail? Why are you being taken to trail? What did you do or not do that the tenant would request a trail? Need more complete information!

Have you contacted an attorney? I would suggest you to contact a lawyer. I am familiar with the lawyer Bechara Tarabay after I checked about him at this website. A lawyer will help you in the best way. I hope this helps.
