What legal authority do you have to foreclose? Are you a lender? An Owner? Who...What? Without any legal basis, you have no authority to file and foreclose on the property.

If you do have some legal basis that gives you the legal right, then yes, you can foreclose. The Executor of the estate would have to make payments to prevent foreclosing on the property.

Why didn't your lawyer explain this to you?
