It's not what your thermostat says, but what the actual temperature is in the tenants apartment! Have you had your system checked out to insure that it is running efficiently and correctly delivers the proper heat temperature to the apartment?

Yes, 2 of my personal friends do plumbing/heating, nothing is wrong with our system. Even whenever we go up there we are baffled why they use the words "freezing cold". Every homeowner and landlord I know says they dress warmly during the winter months and on super cold days would use supplement electric heat if needed. We have noticed they are always dressed in a T-shirt, shorts and barefoot and think that is their issue, they expect the apartment to be as warm as summertime?

Well as long as you can prove that the heat is maintained no less than the required temperature, then you should be able to avoid those $250-$500 fines. It also makes no difference what other homeowners and landlords do, they do not live in the apartment. It also is not important what your tenants are wearing or not wearing. What's important is that you meet the minimum heating requirements per code.

Well put and yes that is what I am doing, paying for the extra heating costs to make sure the apartment is above minimum requirements. Appreciate the info and advice guys, take it easy.
