Well as long as you can prove that the heat is maintained no less than the required temperature, then you should be able to avoid those $250-$500 fines. It also makes no difference what other homeowners and landlords do, they do not live in the apartment. It also is not important what your tenants are wearing or not wearing. What's important is that you meet the minimum heating requirements per code.

Well put and yes that is what I am doing, paying for the extra heating costs to make sure the apartment is above minimum requirements. Appreciate the info and advice guys, take it easy.
