The lease agreement state $45 for bounce checks, and yes he is the one with erenpayment.com, He call me last Friday and i could not answer I was in a meeting so I texted, he was on and on because I never talk to him in the phone I do everything by letters, emails or texts , I wants everything in writing. Anyway he claim he never received any of them, thought he got the one in the door on the Monday before for the 5 day pay or quit, it took him 5 days to answer and on top of that he blames erenpayment for his problems all the inconvenience that brought to him and that he didn't know how to pay rent for November, when I told him several times how to pay November, in writing. Now he said he has the money in the bank he does not understand how did not cash , he said he will bring a cashier check including the charge of $45, but he said he does not have money for the late fees in november . I know I will be better off withhim moving out but if he pays today I can not evict him

the lease agreement, has a charge of $45 and he owes $170 in late fees which I am not charging him, plus he has another charge for $45 for the 5 day notice to pay or quitthat the lease agreement state. I am not charging him late fees nor 5 day notice. So it is a lot less that what he should pay. if I charge him late fees, 5 day notice and the $25 for bounce check would be $240, so $45 still a deal, considering , all the trouble he is giving me.

It's a deal for him because he can refuse to pay the illegal bounce check fee, which means you may not be able to collect any bounce check fee at all! Follow the law!

I do not believe you can access all those charges against the tenant? If your bad check lease clause is prohibited by law, you will not be able to collect any check fees. The court can access a find by state law against you for having an illegal lease clause. The tenant can also seek damages from you too.
You appear to be or work in real state, either in an office or as a realtor, yet seem to know nothing as to your states landlord tenant laws?
