Repairs by Isabella (New York) on December 4, 2017 @12:35

I'm repairing a staircase in my house and the tenant has to move out for 2 days.
Am I responsible for their temporary relocation ?

I don't know what the exact laws of NY say, as I am from Iowa. But generally, the tenant would not be responsible for 2 days worth of rent, but the T could move anywhere they wanted to, for the 2 days, at their expense. Most laws read that way, so a T cannot spend 2 nights in a high-priced hotel at $2-300/night, and expect the LL to pay for it. Besides, the T may be able to crash somewhere with friends or relatives for 2 days, at no cost to them, but may turn around and say their "friends" charged them $100/night, whereas your rent may only be $25-$35 per day.

Yes, you are because the work on the staircase makes the place inhabitable. You might say you have constructively evicted them due to the needed repairs. Your best recourse is to pay for other accommodations. Otherwise you will be liabile for any and all expenses they incur.
