Just wondering when screening tenant using background check up how landlord uses that information to qualify or disqualify applicant.

Is it legal to disqualify based on crime committed?

Not purely on that. But, they still have to meet other rental criteria like everyone else.

HUD says that landlords and home sellers who turn down tenants or buyers based on their criminal records may violate the Fair Housing Act. Primarily what they are talking about is blanket policies that exclude anyone with a record without considering what that record is.

YES you may choose criminal history to be rejection critera.
