I purchased a multifamily in NJ in 2007. The previous owner replaced 5 boilers in 1996 (11 years before). Permits were taken out, inspections performed (it passed). But now 21 years later the city says the permit is not closed because the city requested a "chimney certification" that was never done.

A certificate of occupancy was given to the previous owner by the city (prior to the 2007 purchase by me). Now the city is saying they will not give me a certificate of occupancy because of the 1996 permit.

Does anyone know if that's legal for the city to do? My lawyer is not helping.

Why do you say your lawyer is not helping? Is it because he/she is telling you something you don't want to hear ? Go to your city building dept, and take out a new permit to have the chimney inspection done. Then do whatever it takes to get that chimney certification, to be able to keep your cert. of occ. Instead of spending thousands of $ fighting city hall thru your lawyer, spend the money on complying with them. It's very likely it will pass inspection, just like everything else did 21 years ago. Yes, the city probably screwed up back then, but, unfortunately, you may have to pay the price for that screw-up.
