Why do you say your lawyer is not helping? Is it because he/she is telling you something you don't want to hear ? Go to your city building dept, and take out a new permit to have the chimney inspection done. Then do whatever it takes to get that chimney certification, to be able to keep your cert. of occ. Instead of spending thousands of $ fighting city hall thru your lawyer, spend the money on complying with them. It's very likely it will pass inspection, just like everything else did 21 years ago. Yes, the city probably screwed up back then, but, unfortunately, you may have to pay the price for that screw-up.

Problem is before the chimney inspection the city said they needed to do a fire inspection to close the permit but would not tell me what would be inspected. Made the appointment for the fire inspection but no one came; the city then decided it now needs a chimney certification to close the permit. City is holding up sale of property.

I want the lawyer to get a written explanation of what needs to be done so they don't change the story again.
