It means no smoking anywhere on the premises, either inside or outside. BUT-----how are you going to PROVE they smoke? Unless you actually see someone smoking on the premises, or you get inside the home, and see someone smoking, ash treys sitting around, or it smells like smoke, or cigarette butts are in the yard, it's very hard to prove. Yes, it's legal to deny someone who smokes. About all you can do is put in your ad "NO SMOKING ALLOWED ANYWHERE ON PREMISES", and hope a tenant won't lie to you.
