This tenant has stayed in the apartment for over a year and the lease to converted to month to month. The tenant invited a pregnant woman with a baby to stay for a week. The pregnant woman showed up with 6 other people who had a party, got drunk and shot up meth in the bathroom and left needles on the floor. (Yes, the baby was there during this.) The next morning, they broke and entered the next door apartment and robbed that tenant while he was gone for the day and stole his car. The tenant that invited them inside says she's not responsible for what her guests have done. She even called me after they left to ask me to clean up their meth needles since they didn't throw them in the trash can and she's afraid to touch them.

The people who committed this crime actually came back after the police left because they were in such a hurry to drive off in the stolen car filled with goods that they forgot their personal things and baby items that were inside the apartment. The tenant just let them inside to get their things without calling the police or anything. The other tenants understandably don't feel safe anymore since the tenant seems to be cooperating with the criminals more than the police. The tenant hasn't been accused of any crime.

Can I evict the tenant for having these people in the house? How many days am I required to give her in this case? I want to evict her, but it would take longer if I go by regular month to month lease rules.

I think you should end the lease by doing the typical 30 day notice.
Other wise the best you could do is give her notice of violation.
You don't need to give a reason to end the lease. And I would be very careful in revealing the reason. Maybe say remolding.
I would get a police report for the theft.

I agree with the anon. It may take a little longer that you want, to get her out, but to evict someone for criminal activity, you must have a LOT of proof. Police reports, texts, witnesses, etc. And even YOU say your actual T has not been accused of a crime. To evict someone other than for non-payment of rent, you only have about a 50% chance of winning.

Since she is on a M2M lease, collect March's rent from her, and then give her a notice to be out by May 1st. You still may have to evict her as a holdover tenant after May 1. But your chances of winning are about 90% then, as long as your time frames are OK, and she was properly served.

Do I need to give her 30 days as of date the eviction notice is served or 30 days after end of current month? I am finding conflicting information on this.

Maintaining a Common nuisance is a crime. 30 notice and get them out of there. You are on a month to month. As for the needles she can call the cops back to get them.
