(R) was21 years as tenant. Other tenant (A)reported that R was taken away by ambulance last month. Cannot find R in hospital or nursing home. Police found cellphone# and we talked to R one time. R said he would be back from hosp in couple days. never came, phone is no longer active. Someone did go in apt and took out few things. We went in, found heat on, windows open, big mess. Not much salvageable in belonging or food or clothes. Under NY law, can we store it, trash it, how long to wait before refurb & new tenant? Don

I would re-rent immediately. Is T current with rent? If not re-rent to someone else.

Where is tenant A?

R has clearly abandoned the property...but you have another tenant too...where is A?

If A can be shown to also have abandoned the property...then take pictures, store everything for 30'days...and proceed..change the locks first.

But, if A is still anywhere to be found...you may have to proceed thru court to get a writ of possession.
