I have given a 30 day notice for return of month to month lease property, can or should i file a eviction for none payment of rent due to rent being 2 months behind?

YES. But first, you will need to give them a 3 day notice to pay or quit. Non-payment of rent is a totally separate issue than asking someone to leave by terminating their lease(with the 30 day notice). Besides, if they haven't paid you rent for 2 months, what makes you think they are going to move out at the end of 30 days? So far, they have a roof over their head, and it's costing them nothing to live there, so why move? If they have no money to give you, that means they have no money to give any other LL, either. You should have given them the 3 day notice by the time they were 2 weeks late with the rent 2 months ago. Read your Texas LL/T laws, and your eviction laws, to be able to do this right the first time. Otherwise, it may be summer time before they are out.
