Landlords should ALWAYS have a key to their own properties. Not only for emergency purposes, but if you kick someone out, and they leave you no keys when they are evicted. Send a written letter, both reg and certified mail,to your tenant, stating you want a key by a certain date, and that if they don't comply, you will hire a locksmith to drill out the old lock(s), replace them with new ones, and charge the T for the replacement the next time rent is due. Be sure to mention that the cost will come out of their rent payment FIRST, before the rent gets paid, thereby possibly them owing you rent, in which you will then give them a 3 day notice to pay the rest of the rent, or move.

Problem is he threatens us with discrimination just for calling him for rent which we do have to call to get or it doesn't get paid. Refuses us a key. We don't want to go in but we can't even fix anything he complains about unless he is there and always only at his convenience. We have no problems with any other tenants and always fix anything right away

    You seem to have a very difficult tenant. When is his lease up ?? Some Ts have a "shelf life" and I think your T is reaching theirs. From now on, do not accept ANY calls from him, and do not CALL him. Send him a letter like I described, and include the fact that from now on, you will ONLY text or send letters back and forth. You need proof/documentation of EVERYTHING between you two. You don't get that with phone calls. You want to be legal----this is legal, and will hold up in court. If he is late with rent, DON"T call him. Send the 3 day notice to pay rent or quit, and WAIT ! If you have to do that every month, then do so. Just be sure it follows the correct procedures and forms according to your state LL/T laws, and the eviction laws. If he slips up, start eviction on him. Him changing locks, and you having to give several 3 day notices, is grounds for giving your T a notice of termination at the end of the lease. Save copies of ALL texts, letters, and notices, in case you need them for a court date. Your T is a PITA, and needs to go ASAP. There are other tenants out there that are better than the one you have now.

I wouldn't bother with the letters. Don't call when next rent payment is due. If your lease is written correctly, the day after rent is due file for eviction.
