Tenants lived in the home over 3plus years she a handicap barely can walk and he is a independent meat seller with additional tenant not on leased person living there appears to sub-leasing. They love the home. The home was built-ed 1929 and had aged all the floor are not leveled in some areas of the home. We feel by they letting us know about the discrepancies we are being set up for a law suit> Please advise,

You need to define what you mean by discrepancies. What is it they want from you?

If you are worried about a possible future lawsuit, then you need to start thinking about all things "LEGAL" YOU need to WRITE them a letter saying if there is ANYTHING in the home that they think needs repair, they need to WRITE you a letter explaining what they want repaired. This is called DOCUMENTATION, and you need to have it for anything that may happen in the future. If they just "happened to mention" something several months back, and you both forgot about it, then putting things in WRITING (and dating the letter) will put both parties on notice. Judges like to see documentation, rather than parties trying to remember what they said way-back-when.

About the floors-----because the person can "barely walk", she probably notices the unevenness of floors a LOT more than most people do. To get floors perfectly level in an old home, it would take a major renovation job. I think you are worrying over nothing. Once you write them a letter, and you get something back (in writing), THEN you will know where you stand.

Why would you TELL a tenant that you're suspicious might sue you to "put it in writing"?!

Wouldn't the goal for the landlord to have a defense of "I was never notified according to our state's laws?"

End the lease due to subletting violation ASAP. Problem of the discrepancies will not be an issue for them at that point. Un-less your floors have majorly shifting going on. Then a new tenant may be order. Life to short to listen to most T complaints. lol

You should send them a 5 day notice to vacate stating that because they are complaining about the property's habitibility, they need to expedite their move.
