Tenant just texted me to move out today! (NJ)

My tenant is with Military and doing recruiting type of job. The lease signed with him is 2 years. He has just stayed here for a few days more than a year.
He just texted me, and needs to move out today, because he received an order. This is a surprise to me. He never mention it to me any thing like this, or anything he would receive an order and to leave.
My question is, Can I take his a month and half deposit? Is there any different in the case of military order?

Read the Servicemember Civil Relief Act (SCRA), section 5.

He already made several missteps: notification must be in writing and he must show proof of the order to deploy or a letter from his CO. If it is in order, the lease terminates 30 days later. I suggest you respond that he needs to follow the SCRA guidelines by providing those things or he may be responsible for the remainder of the lease.
There may be other considerations for New Jersey, but I did not come across any.
If he is trying to use the SCRA to scam his way out of a lease, I wouldn't let him. However, if he really is being redeployed, be cordial and professional about it.

Two points to remember: 1. Orders must be for either a Permanent Change of Station (PCS) or a deployment longer than 90 days. 2. The termination becomes effective 30 days after the next rental payment is due. That means that if your rent is due on the first of the month, and you deliver your notice on March 7, the termination date will be April 30th.
