In SOME states, if they gave a 30 day notice on the 22nd of the previous month, then they would be entitled to the 8 day proration. I know that Oregon is tenant friendly in that regard.

So in short, it depends on (a) your state's laws and (b) when the notice was given.

Or (c) you can just refuse to refund it because they most likely won't sue you for 8 days of rent.
