I am a tenant in a condo and my landlord allows me to sublease my extra bedroom. I have a tenant (sublessee) who rents a room in my house who is on a month-to-month lease. I previously issued him a 60 day notice to terminate his rental agreement but he refused to move out. I sought consultation from a lawyer who explained that due to improper and insufficient language I used in the termination of the rental agreement, the court would likely rule in my tenant’s favor. The lawyer advised that I give my tenant another 60 days with a new termination notice with corrected language, which I’m comfortable with. One of the issues I have with my tenant is that he has moved his girlfriend into the home despite me having numerous conversations with him that she is not to be in the home when he is not here. For several weeks they previously attempted to hide the fact that she was living in the home but now she behaves as if she is a resident. She is in my home alone daily when I am at work, he washes her clothes so excessively that the washer and dryer are now malfunctioning, she runs the air conditioning excessively, and she plays music loudly in the common area of the house in the middle of the night. The sublease states that he is not to have any guests for more than 7 consecutive days.

Is there anything I can do to in effect “evict” his girlfriend? Can I issue an unlawful detainer to his girlfriend?

Get a new lawyer. Review your lease and landlord tenant law for your state. Document everything going on. Post cure or quit notices for every violation.

Whatever your lease with your landlord says your with your tenant should say the same. Good luck.

Is a 60-day notice necessary, or would a 30-day suffice? Depending on your state laws and how long your tenant has been there, 30 days might be all you need.

What's your goal here? Do you want to get rid of this tenant, or would you be satisfied if he abided by the terms of the sublease?
