I'm confused what the OP poster is asking for. I can't believe she's asking for the 7 months rent since they both agreed that she would leave. the OP decided to try to sell and has a contract to sell, to just now with closing Sept 4 worrying about the current renter and not having that all taken care of.
Who does everything by verbal or phone? If nothing else the conversation would have been followed up with a letter stating what was agreed upon.
I would hope that the tenant would "honor" their verbal agreement since the tenant was the person who at the beginning wanted out of the lease.
Put things in writing!

    You have a lot of ole' school landlords that do their rental as a "hobby" and havent a clue about state law and deal with tenants in that same mindset who don't know the law. So thats where that comes from.

      I, for one, wasn't implying there was any "agreement", Most generally talk to the applicant - I wouldn't every just e-mail. When talking with the person asking the prequalification questions - I can tell whether they can put a sentence together-- begin to "talk too much" and complain about how rotten their ll is. Once we get past that & I show the house meet in person and they fill out an application. I ck them out and offer them a lease which is in writing.
