ESA issue

I have a tenant that started claiming ESA after being caught red handed. My lawyer said there is nothing I can do. My question is if a tenant moves in with a disability and required modifications (ramp or grab bars in the bathroom) to the apartment then they have to pay for it. And pay to repair any modifications.
Why cant I require the tenant to pay for modifications to the apartment unit to make the unit sound proof?
The walls and flooring need upgrading because the barking can be heard outside the unit, below, and next door.

Document noise issues carefully. After second or third complaint send a friendly notice notice of violation to tenant. After next noise complaint send a cure or quit citing previous complaints with specific complaint dates. Tenant is violating other tenants rights to peaceful and quite enjoyment and may result in loss of income to you as LL. Is is taken seriously by the courts in LL favor.
TRUE, PROPERLY TRAINED ASSISTANCE ANIMALS do not create noise problems.

Emotional Support Animals (any animal a random therapist can write a letter for) are different from Service Animals (trained for a specific health reason, covered by ADA).
