We live upstairs, and one of tenants live down below our bedroom. In daily basis, he talks on the phone to overseas sometime through midnight. We are deeply disturbed, and we can hear almost every words he speaks, although we don't understand the language.

There is section in the lease called "QUIET ENJOYMENT" which clearly stated talking loudly is not allowed from 10pm - 7am along with any other type of noises.

I kindly warned him many times through phone, text or other roommate of his. But, he doesn't change.

What my options are?
The lease is going to be ended in Jun of next year, can I terminate it earlier for this reason?
If I bring him to the court, would Judge be on my side?

I meant, if judge would support me to eject him/them? This is a 2-family house.

I can imagine how frustrating that is. My neighbor does a similar thing. Spends all day on the phone with her front door open. That prevents me from being able to open my doors or windows without her disturbing me when I'm trying to work. I've talk to her about it several times but nothing changes. I know WAY too much personal stuff. I wish I had a solution for you.

T is violating the lease clause. What provisions are in your lease that cover such an issue? If nothing, Just give them 60 or more days notice that you will not be renewing their lease. No explanations are required. They clearly do not respect you or other tenants and do whatever they like. "Entitled" syndrome. Just rid yourself of this problem. In future, beef up your "peaceful enjoyment" clause to cover such violations. It's tough going to court, you need to calculate the costs of legal action vs. enduring to end of lease. Have you offered the offensive T the option of relocating elsewhere? He/she may take you up on it. Early Lease Termination Form.

Just had another thought: if T is yaking on phone in a loud voice from 10pm to 7am, have you considered calling the POLICE as this is a disturbance. Maybe speak to Police Chief and ask if the Police could provide them with a visit and citation and fine for such stupid inconsiderate behavior. It would be similar to someone having a loud party between 10pm and 7am! The T is making calls to a foreign country in a different time zone, hence the horrible time of day our time. Police know how to deal with peeps that disturb the peace. If that works, most likely the yakker will high tail it to another rental elsewhere! Problem solved.

Wear earplugs. This is going to be really hard to enforce in a small complex. The walls are likely pretty thin and someone talking at a normal level will seem extremely loud throughout the building when there are no other noises are sounds around. What you think is talking loudly, could easily be a normal tone that sounds loud since there is nothing else to compare it to when it's quiet at night. Personally, this is part of living in a multi-unit property. If you own the property, you may have to reconsider living in it.
