Do you have it in writing from your tenant that she will be out by May 31? Has she paid you May's rent? At this point, you don't want to make her mad, as she could leave you with a bunch of damage and cleanup costs if you try to force her out. If she needs to have an extra week in June before she can move, give it to her.

Put it in writing (and send regular and certified mail) that you will not charge her any rent for June if she gives you the keys back on June 7, and leaves the place clean, with no damages. But if no keys back by June 8, the entire rent for June will be immediately due. Then give her a 3 day notice to pay rent or move, on the 8th. Do not do anything with the Realtor, until you have possession back, and have the property totally ready to show. Remember, SHE is in control of the situation right now, not you. If you don't want to spend more money, and possibly several weeks trying to get her out thru the court system, treat her with kid-gloves till she's out.

By the way, your original lease with her was going to be up June 30, and you were expecting her out by then. So if you can get her out 3 weeks before that, you are still ahead of your original plan/schedule.

Garry - Thanks for your input and putting in perspective about the original schedule.

It is in writing that she is moving out May 31 and she paid full for the month of May.

I'm still worried that she will not move out after June 6 because she has not found a place. She's already upset with us because reality hit her and move out date is getting closer.

If she doesn't move out July 6 and charge her the full amount for the month of June, we're pretty much back to square-one. Wouldn't she then have the right to stay until June 30 because she paid the full month? And then the whole cycle might repeat for the month of July?

    tell her for insurance reasons that you need to see a copy of a rental application that she made in April. then you will see whether (1)she actually had a moving plan and it just got changed or (2)whether she is being dishonest.

    If it is 1 then be patient
    If it is 2 then take precautions.

      Again, thank you.

      I don't know if I can ask for rental application she had in April. I'm pretty certain she secured a place, but she changed her mind last minute due to a request she had that was not met by the new landlord.

      The start of anger towards me is when I asked to see a signed lease agreement with her new rental with a move-in date of 6/6. I told her that I would base my decision to extend her stay on proof that she has a place to go on 6/6. She questioned why she needed to provide that and went on a tirade that I am taking advantage of her. She said she has a lawyer and I must meet her requests. Tenant can't produce document and her new landlord never called me as a reference - that's why I'm a bit suspicious.
