Industry standards seem to be that by the fifth,...or even the tenth of the month,....is ON TIME.......and your tenant is paying the late fees.
Most judges will not allow late fees, penalties, bookkeeping charges, liquidated damages, additional overhead expense,......what ever we want to call it. To the judges it's all just JUNK FEES no matter what the lease says or how clearly and carefully the wording was crafted.
The more gracious of judges will allow the LL to pursue those monies in a different court at a subsequent time, in a new / different action No matter what the actual law might be as it applies under LLT law or under contracts law.
I've stood before judges who have straight up said...."" In my courtroom,..by the fifteenth of the month is on time."""
