Also, she said the "inspector" said this & that. If that was really a fact, why didn't she scan or photocopy the persons report so you could address each specific issue.
Sounds like she's short of cash & wants to bluff her way into you turning over the past rent.

I felt like that her inspector gave her some report. 2 weeks ago, I asked her to withdraw the case, and I gave the rent back to her. She did not respond. Last week, I got back from vacation, and checked the property, and found out that some of things she complained were not true. So I just emailed that I would give her $700 for her to withdraw the case after the findings. Based on what she wrote in her email what the inspector found 2 years ago, the inspector was very subjectively in her favor. I plan to undermine her inspector's credibility by showing judge some pictures, some common knowledge from internet, and emails with answers from one licensed home inspector.

In my opinion, you have just undermined your OWN credibility. Her rent was $2,000. You just offered her $700 (a third of her original rent), to drop her lawsuit. Apparently she did not take that offer, as you have just said you are going to show the judge some pictures, etc. Once you offered that amount, she knew she had a fairly good case against you, and will now use your offer to her, as further proof that you owe her the full $2'000 back. I realize you were just trying to save some money, but that may have just backfired on you. I now only give you about a 20% chance of winning, because now a judge may award her at least the $700 only because you were willing to give her that much back even before going to court.

Garry -- just to chime in here -- I believe in most courts, settlement negotiations are not considered admissable as evidence for anything. -- but i'm not an attorney and am the last one to offer any type of legal advise.

This is my first time to go to court against someone. I really do not want spend time on this. This was what I wrote to her on June 29th, "I just got back from vacation this Thursday and checked out the townhouse this morning while current tenant was there. ... I have 2 options at this points after finding all the facts. Option 1, I refund you $700, and you withdraw the civil complaint. I do not want to spend too much time on this." Last Tuesday(7/2) I filled up Notice Of Defense. I think I should send her another email to withdraw the $700 offer because I just decided to spend time on this, right? Or I do not need to send her any email? Victor
