a married couple rented my apartment they're going through a bitter divorce and the husband wants to terminate the lease even though both signatures are on it also they both live apart

so will she have to sign a brand new lease and do i have to send them both a termination of lease

and since the new rent rules went into effect recently will it be HARDER to do an eviction process since nyc is a super tenant friendly state?

As a landlord, you NEVER want to let ANY parties to a lease, out of a lease, while any of those parties to the original lease are still living there. Better to have BOTH/ALL parties legally responsible for the rent and/or damages than just one. Did you get Sept. rent, and have they paid Oct. rent yet? If not, start eviction procedures tomorrow by giving them a 3 day notice to pay rent or quit(move).

Send all letters to both parties, at your apartment address, even if you know one of them may not be living there. DO NOT sign a new lease with her, unless you ABSOLUTELY KNOW she can pay the rent on her own.

I'm from Iowa, so I don't know NYC eviction procedures. Yes, it's always hard to evict someone in ANY state. So if you are not totally up-to-date on your eviction laws, then you should probably hire an attorney to help you.
