My cousin who is a landlord signed a 10 yr lease for a family member who is now 7 months behind and is violating the lease isnt the maximun a lease can be 2 years? Will a judge uphold a 10 year lease? isnt it illegal?

5,10, 15, and even 20 year leases are common in COMMERCIAL settings, but NEVER in residential living settings. Yes, most all states cap a residential lease at 2 years, and in some states, it's only 1 year at a time. But WHY is your cousin allowing a family member to be 7 months behind? S/he is being WAAAAY to nice to the family member.

Being behind, or not paying rent, has NOTHING to do with the length of a lease. Your cousin needs to read the his/her state's LL/T laws, and their eviction laws, and EVICT the family member for non-payment of rent.
